Terms of Service
Effective July 30, 2026
These terms govern your use of the Mapout Creative website. Paid client services are also governed by the proposal, agreement, statement of work, or invoice accepted for the project.
1. Acceptance of Terms
By accessing this website, submitting an inquiry, booking a call, or using our services, you agree to these Terms of Service. If you do not agree, do not use the website.
A separate signed or accepted proposal, service agreement, statement of work, or invoice may apply to client services. If there is a conflict, the specific client agreement controls for that service.
2. Our Services
Mapout Creative offers custom websites, web and mobile applications, UI/UX design, custom CMS and client panels, ecommerce and booking systems, business automation, AI integration, social media marketing, SEO and performance services, managed hosting, maintenance, and support.
Features, deliverables, schedules, revision limits, hosting, warranty, and support are included only when stated in the applicable proposal or agreement.
3. Quotes, Pricing, and Payment
- Website prices are starting rates and may change without notice before a proposal is accepted.
- Localized currency displays are estimates; the approved proposal or invoice is the final pricing reference.
- Payment schedules, deposits, renewal dates, taxes, fees, and accepted methods are stated in the applicable proposal or invoice.
- Work may be paused for overdue amounts. Deliverables, launch, transfer, or access may be withheld until required payments are received.
- Client-approved third-party costs, subscriptions, licenses, transaction fees, or premium assets are the client's responsibility unless expressly included.
4. Monthly and Promotional Plans
Monthly plans are managed services and may include hosting, SSL, maintenance, monitoring, backups, CMS updates, AI usage, and support according to the selected plan.
Promotional annual offers may show a discounted monthly equivalent but require prepayment for 12 months. Renewal occurs at the stated regular rate unless different written terms apply.
Cancellation, renewal, refunds, transfer, data export, and early termination are governed by the service agreement accepted at purchase.
5. Client Responsibilities
- Provide accurate requirements, content, credentials, approvals, and feedback on time.
- Ensure you have rights to all text, images, logos, data, trademarks, and other materials you provide.
- Maintain secure credentials and notify us promptly of suspected unauthorized access.
- Review deliverables and report issues within the agreed review or warranty period.
- Comply with laws, industry rules, privacy obligations, and third-party platform terms that apply to your business.
6. Scope and Change Requests
The approved proposal defines the project scope. Requests outside that scope may affect cost and timeline.
Additional work requires a documented request, estimate where applicable, and client approval before implementation.
7. Design Revisions and Approvals
Design revisions occur during the design phase and are limited by the selected package or agreement. Development begins after written design approval.
Major design changes requested after approval may be treated as additional work. Client approvals and sign-offs may be relied upon to continue the project.
8. Timelines and Delays
Timelines are good-faith estimates unless expressly guaranteed in writing. Delivery can be affected by scope changes, delayed content or approvals, third-party services, technical discoveries, force majeure events, or matters outside our reasonable control.
We are not responsible for delays caused by missing client materials, unresponsive stakeholders, third-party outages, or approvals outside our control.
9. Intellectual Property and Ownership
Ownership and license rights are defined in the applicable client agreement. For qualifying One-Time projects, ownership of the completed custom deliverable transfers after all required payments and obligations are satisfied.
Mapout Creative retains ownership of pre-existing tools, know-how, reusable components, frameworks, processes, and materials not created exclusively for the client. Where included in a deliverable, the client receives the rights needed to use the completed project.
Third-party software, fonts, stock assets, APIs, plugins, and services remain subject to their own licenses and terms.
10. Portfolio Rights
Unless a written agreement states otherwise, we may identify the client and display non-confidential completed work in our portfolio, case studies, proposals, social channels, and marketing materials after public launch.
Confidential information and unpublished business data will not knowingly be disclosed for portfolio purposes.
11. Third-Party Services
Projects may depend on hosting providers, domains, payment gateways, APIs, AI providers, social platforms, app stores, analytics, email services, or other third parties.
We do not control their availability, pricing, policy changes, approvals, security incidents, or service interruptions and are not responsible for their acts or omissions.
12. AI Features
AI output may be inaccurate, incomplete, biased, or unsuitable for a particular purpose. Clients must review AI-generated content and decisions before relying on them.
Do not submit regulated, confidential, personal, or sensitive information to an AI feature unless an approved data-handling plan is in place. AI usage limits and third-party provider terms may apply.
13. Warranty and Support
Any warranty covers qualifying defects resulting from our original development during the stated warranty period. It does not cover new features, redesigns, content changes, third-party changes, client modifications, unauthorized access, misuse, or infrastructure outside our responsibility.
Support, maintenance, response times, backups, and monitoring are provided only to the extent included in the applicable plan or agreement.
14. Acceptable Use
You must not use our website or services to:
- Violate law, intellectual-property rights, privacy rights, or third-party terms.
- Distribute malware, spam, deceptive content, or harmful code.
- Attempt unauthorized access, disrupt systems, evade security, scrape excessively, or misuse forms and APIs.
- Build or distribute unlawful, fraudulent, abusive, discriminatory, or dangerous products or content.
15. Disclaimer
The public website and its content are provided for general information and on an as-available basis. To the maximum extent permitted by law, we disclaim warranties not expressly stated in a signed client agreement.
We do not guarantee specific revenue, leads, sales, search rankings, social-media growth, uptime, app-store approval, or business outcomes. Results depend on many factors outside our control.
16. Limitation of Liability
To the maximum extent permitted by applicable law, Mapout Creative will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities arising from the website or services.
Where liability cannot be excluded, our aggregate liability relating to a specific paid service will not exceed the amount paid to Mapout Creative for that service during the six months preceding the event giving rise to the claim, unless applicable law requires otherwise.
17. Indemnification
To the extent permitted by law, you agree to indemnify and hold Mapout Creative harmless from third-party claims arising from materials you provide, your unlawful use of the deliverables, your violation of these terms, or your infringement of another party's rights.
18. Suspension and Termination
We may suspend access or services for nonpayment, security risk, unlawful activity, abuse, material breach, or conduct that may harm Mapout Creative, our providers, or others.
Termination rights and consequences for paid services are governed by the applicable client agreement.
19. Governing Law
Unless a client agreement states otherwise, these terms are governed by the laws of the Republic of the Philippines, without regard to conflict-of-law principles. The parties will first attempt in good faith to resolve disputes informally.
20. Changes and Contact
We may update these terms by posting a revised version with a new effective date. Continued website use after an update means you accept the revised terms.
